So long story short, i sold a 6106 dress watch ages ago on eBay to fund another purchase. The guy was a local dude about 20 minutes from me, paid for the watch no problems and said he was going to come pick it up that coming weekend. He messaged me the saturday morning and told me he had the man flu and he'd pick it up the week after.
It's been like 4 months since, and i haven't heard from the guy. I accidently deleted his text message, and had cleared out my ebay messages also. Not only that, neither of us left feedback for the other.. and after it sold i had deleted it from my "sold" section on ebay.
I literally have no way to find this guy.. and he has not been in contact with me either.
Should i resell it? Or how long should i have to hang onto it for?

Okay so i found it in my paypal payments and did manage to find the guy so i'm going to send a message now. It was only two months so i guess time has gotten away from me.. but still, who pays for something and waits over two months to pick it up?
What would you guys do?

What would you guys do? he's paid for it so you need to hang on to it for a year. After that you should be free to resell it but refund him his money first.

Is there any actual law that says a year specifically? I haven't been able to find anything in Australia relating to this sort of situation.
I don't think it's fair to refund the money though (it isn't much..) because why should i lose out because someone can't be bothered to get off their ass and drive 20 minutes down the highway and grab it?

Technically and legally, he has bought and paid for the item. It is now his property no matter who is holding it. It is no longer yours to sell. The laws on unclaimed goods will vary from country to country. I can't help you with finding out what the rules are in Oz but there are several members here that should be able to help with that, being local.

Ebay sucks like this. As a seller you're obligated to provide a product like, yesterday, and can't leave negative feedback. As a buyer, you can simply not pay for stuff you've purchased and leave horrendous feedback for fairly minor issues without even notifying the seller there is an issue.

In AU the deal is around 6 months. In any case, I'd just refund him and find a new buyer. This guy is the kind of guy who is going to have buyer's remorse and shaft you hard in feedback. He hasn't left me any feedback at all and he came across as quite a reasonable bloke when i last chatted to him. I don't know why he never bothered to pick it up but i sent him a message telling him to come and get it or i'll resell it. So i guess the balls in his court now, whether he can be bothered or not. It's not like i'm trying to shaft the guy, i want him to come and get it.. but if he can't be bothered why should i have to hang onto it and chase him up?

You lost his details and he may have lost yours.. what he called man flu might have turned out to be something more serious.. influenza has been worse this year.. do your best to complete the transaction and you won't end up with niggling regrets and your honour will be intact too..

Yes that's true. I've caught it four times myself so i know what it's like. If he gets back to me and can't pick it up i will offer to post it for him as the post office is only up the road. I don't like that it's been left unfinished so when i remembered after i made the post about checking the details on paypal i did find him.
If he doesn't get back to me i might just have to try again in a few months or i'll use it as a practise movement to strip and put back together.
I have had other people do this in the past but they don't pay for it.. just win it.. and don't even reply to you. Very frustrating some people..

I had a similar situation a couple of years ago. I sold a gramophone and the guy didn't want to risk it getting damaged in the post so said he would collect it. After a bit of toing and froing he said he was coming past me on the way to Norwich and would pick it up then. A provisional date was set then I heard nothing more from him. I tried to contact him but only had a work e-mail address and got no replies.
A year later, I tried to contact him , offering a refund less Paypal/Evilbay costs. Got a reply saying he'd been in hospital for 10 months with bowel cancer and had forgotten about it. (I don't suppose it was a high priority !) He was very grateful and did eventually collect it. I still get the occasional e-mail saying he's taken it with him out on a picnic with his family in their Austin 7.
So, I would give him the benefit of the doubt and contact Evilbay to find how long you have to wait before reselling.

Having tried to contact him I'd just put it in a box and wait to see if he ever gets in touch. It costs you nothing and I think that after a short period (2 months?) he can no longer post feedback. Worst that can happen is he makes a claim through PayPal, and you've got the email exchange showing he agreed to collect it.

PayPal will simply ask for tracking to prove delivery no matter what the emails say.
This is simply because the contract as far as PayPal goes is to prove the buyer has the item. If that isn't possible or the sellet acknowledges at least that they still have the goods then it will have to be refunded. The buyer has 180 days to raise a claim. Maybe more maybe less direct with the bank.
I agree in many ways that why you should be keeping hold of it for what looks like an inevitable resell, however you really have two options, failing the guy coming to get the watch and they are:
1: post it to his address on the transaction, at your own cost and if the address is there. Make sure it's marked eligible for seller protection and send it tracked.
2. Refund it in full and move on. Warn him for 48 hours that if there is no response that you will unfortunately have to resell.
Personally as it's not really taking up a huge amount of space ( I have dealt with cases where the seller paid storage costs for car parts or sofas etc and the buyer in the end simply got a refund) I would allow him some time to arrange collection.
I would refund it (after serious consideration not to...) Once 180 days is up. It would be the right thing to do, even though the buyer is at fault.
The reason I say this is because you could be hit with a chargeback, depending on whether or not the bank would reverse his payment even after the typical 120-180 days are up (I've seen it happen) and as a result you could be hit with fees.
If the payment was a personal payment then this is still a possibility, even if maybe no PayPal case could be raised.

I sold a 6309-7040 a couple of years ago and the buyer asked if he could pick it up as he lived a couple of miles away. He did not show up for two months and was uncontactable. Eventually he sent me a text saying can he come round next week. Turned out he is a commercial pilot and was working a contract in the US. We have met up several times since then.

Aloha , I have to agree 100 % with ........... Peter and Tony (ANZAC ) and lordflagtree on this. Well because I am a honest guy and do things honestly also and that is what I would do with all this. As Tony said the Health area's and Accidents do happen and are very bad lately with many. Try to give the guy a benefit of it again in his decision's, it wont hurt and if he decides to have his money returned, try to assist him with it then you have a chance to re-sell again.
Just a little Point: Remember our good friend .......... ( The Neilo- The Aqualand King ) when he had that accident, then he comes back again and explains what happened to him. It could have been a member of Our Own Forum also that might have happened to get like this and then we find out what might have happened. (JMHO to this.) Aloha Louis

Most people are right here. I'm fairly pessimistic as Australian buyers are notoriously fickle and underhanded (Maybe it's just Adelaide?). Every time I've helped someone out with a purchase like this I've paid for it with bad feedback or financially, so I just don't do it now.

Thanks for all the replies guys. I've sent him an email to get off his ass and come and pick it up.. if i don't hear from him i'll probably put it in a padded envelope and post it the absolute cheapest way possible the next time i go to the post office.
Really now that i think about it.. i was in his area on Saturday.. i should have just dropped it at his house. Perhaps i'll wait till i'm up there again and just leave it sticky taped to his front door..
